| | | | | | | | PURPOSE: To request that the Board of Aldermen accept a Petition for Annexation (Attachment #1) submitted by Harold Max Kern III on behalf of Point at Elon, LLC. |
| | | | | | | | HISTORY:
- On March 26, 2019, Harold Max Kern, III submitted a Petition requesting annexation for 28.999 acres (Attachment #1) on the behalf of Point at Elon, LLC. The signed petition was accompanied by a metes and bounds description of the property.
- The annexation request is associated with a Major Development Plan consisting of a forty-seven lot single family residential subdivision scheduled for a public hearing with the Board of Aldermen on April 1, 2019. An image showing the entire area proposed for annexation is attached for reference (Attachment #2), as is the legal description of the property (Attachment #3).

| | | | | | | | FACTS AND ISSUES:
- The annexation petition proposes to bring 28.999 acres into the town's corporate boundary.
- The property is owned by Point at Elon, LLC and is expected to be developed for single family detached homes. The proposed project has been reviewed by the Technical Review Committee and has received preliminary approval pending submittal of fully engineered construction documents. The project proposes to construct forty-seven (47) single family detached dwelling units on new roads making connection with Shallowford Church Road and Cable Road.
- The property is split-zoned, with the western portion zoned Neighborhood Residential (NR) and the eastern portion zoned Suburban Residential (SR). Single family detached dwellings are a use by right in the NR and SR Districts and therefore no change in zoning is being proposed.
- The process for annexation, with expected action dates, is as follows:
- Acceptance of a Petition for Annexation (April 9, 2019);
- Adoption of a Resolution Directing the Clerk to Investigate a Petition for Annexation (April 9, 2019);
- Acceptance of a Certificate of Sufficiency Regarding a Petition for Annexation (May 14, 2019);
- Adoption of a Resolution Fixing the Date of a Public Hearing on a Question of Annexation (May 14, 2019);
- Public Hearing Regarding a Petition for Annexation (June 11, 2019);
- Adoption of an Ordinance to Extend the Corporate Limits of Elon, N.C. (June 11, 2019).
